Apopka, FL - A Florida police officer has been arrested and charged with DUI after he was caught with an open can of beer in his cruiser's cup holder.

According to Eustis police, Apopka police officer Oscar Mayorga was arrested on Monday evening after police conducted a traffic stop and found an open can of beer in his cruiser's cup holder.

Mayorga, 25, was wearing his uniform and was in his marked patrol cruiser when the traffic stop was conducted.

Eustis police say officers also smelled alcohol on Mayorga’s breath.

Mayorga allegedly told officers he took three Benadryl pills a few hours before his shift was set to begin, and rejected performing standard field sobriety tests.

He was taken to the Eustis Police Department to conduct certified breath tests, where one of two breath tests revealed a BAC of 0.391g/210L, indicating severe intoxication.

Apopka police recovered Mayorga's vehicle and equipment.

The officer has been suspended without pay.
